    Question re: conversion of 13 to 7

    I wondered, I'm approximately 10k in arrears in my mortgage (which, as a side note, I don't understand as I was only 4 payments of $700 each behind). Anyway, I'm in ch 13 now and wondered...in theory, if I could come up with 10k and get current on my mortgage, would I get in trouble for doing so if my intent is to then convert to ch 7? I guess I'm saying, would they come back and question, well, if you could find 10k, why should we let you convert to a ch 7? Just wondering, would like to convert and be done with it but don't want to lose the only thing in the world I have which is a very small home. Thanks.

      That is probably not a good idea...the reason being is that the Chapter 7 trustee (assigned after you convert) will try to undue the payment made to your mortgage bank as a fraudulent/preferential transfer. Once the trustee undoes that transfer, then you are in a chapter 7, still in arrears on your mortgage, and will probably lose the house at that point.

      What other debts are in your Chapter 13?

      You can always dismiss yoru Chapter 13 case, but then you are back to square one.
