    Is this even legal? Trustee wants tax refund from year '06

    We filed Chapter 13 on 12/06/07. We received the trustee's objections 2 weeks ago. There were several objections, and one was about our tax refund. I had been so worried that she was going to want this year's take refund, I read the paragraph wrong and thought that she was, in fact, referring to our '07 refund, which we haven't received yet.

    However, I spoke to my atty yesterday because he had called to remind us that our confirmation hearing is today. He stated that he had never seen anything like this nitpicking that our trustee is doing, and then went on to explain that she wants our 2006 tax refund, which is a refund that we received in April of 2007!!

    So I reread the paragraph, and yep, he's right. Here is what it says:

    "The debtors' federal 2006 tax return shows a tax refund of nearly $XXXX.00 As the debtors' monthly expenses are covered by monthly income, the tax refund constitutes disposable income and must be turned over to the trustee to fund the plan. A tax refund is overwithholding of income taxes - a "virtual savings account" that is appropriately contributed to the plan to satisfy the disposable income test. (Lists a case citation) - a Chapter 7 case in which the Court held that tax refunds need to be considered part of the estate; Prior case law supports this position. (List more case citations)."

    WHAT? How can this be legal? That money is long gone, so I guess she is out of luck. But I'm just wondering how she can even request this or why she would request it when we received the money almost a year ago, and we filed bk 8 months AFTER having received it!

    I think that the trustee must want future tax refunds, including the 07 you'll get this spring, and is using the amount of the 2006 refund as an example of how you are over-withholding as a form of a "virtual savings account". But since the hearing is today, I assume it will be clarified then. That money was withheld in 06, paid in 07, many moons before you filed, so I don't see them having a leg to stand on asking for it. Do you have an exemptions you can use to cover your 07 tax refund? And then adjust your holding so you don't get any in the future, and problem solved.

    Plan Modified July 8, 2009 from $1100/month to $400/month due to change in income, finally discharged in July of 2013!

      I agree, I don't think the trustee literally wants your 2006 refund, but is merely making an argument that the tax refund constitutes income and therefore should be part of your disposable income and is using your 2006 as an example.

        See, that's how I interpreted it at first, too, but then when I talked to my attorney yesterday, he seemed to think that not only does she want the money from our '06 refund, but also will want future refunds, of course. I suppose it could be interpreted either way, but this trustee is evil, and like our atty said, nitpicking us to death, so I was thinking that his interpretation was right.

        I guess we'll find out.

          My husband just got back from the hearing. He said that our atty went up and asked the trustee how she intended to get that money since we received it early last year. She said she had made a mistake and that she was talking about our '07 refund.

            That is what I thought, the trustee wants the 2007 refund (and possibly all future refunds for the life of the chapter 13 plan).

              Glad things were straighten out for you.

              Well at least I know if we have to file CH13, they won't be able to go off last years taxes, because they are way higher than what we got this year. We changed our exemptions.

                I would be raising my exemptions and show this trustee a thing or two and not get ANY refund back so she can't take it. OR apply the refund to the next years' taxes.......then she gets nothing, then keep rolling it over until your done with your plan in which you will get a whooping refund after your plan is done!

                  What it sounds to me like is that your trustee is saying, I'll use an example ...you got 12K back on taxes which means there is 1000/month in "disposible" income not showing up in the plan. I would say he is wanting more of a monthly payment based on past income tax refunds.

                    Is this (tax refund) an issue only in Chpt 13? Our attorney said we could use our refund prior to filing 7 to pay bills, get caught up, etc...got the state refund back this week so made final attny. paymnt (yay!), now just waiting on the Fed.
                    It's SO stressful, as I have a 3/14 court hearing on a Chase suit, and we have to get current on the mortgage ($800) prior to filing, so we scrambled to get the taxes expedited (bless our CPA), am just hoping we have enough time. (sigh)

                      Your 07 tax refund may not be an issue. I filed on 4/3 and nothing was ever said about the tax refund.
