ch 13 did not pay my payment

i did not pay my payment for 5 months, got a letter they werre going to dismiss without prejudice. well it said otion 1 to pay the arrears in my case $5325. which i went ahead and did yesterday.

there is a hearing april 24 at the bk court, what will come out of this? anyone ever not made payments and then paid the arrears back to get caught up? i am completly caught up now. should i have anything to worry about? the lawyer says i have nothing to worry about but he has seen them still dismiss even if ur caught up

I will only echo what your attorney said, you should be fine. If the sole grounds for the motion was for lack of payment and the letter you got from the trustee gave you the option to cure the default, and you cured the default; there really are no grounds to sustain a dismissal.

If the hearing does not get vacated (you would see an order vacating the hearing on PACER), I would suggest actually going to the hearing to make sure the action gets dismissed.

How could you get 5 months behind? ( not judging ) Payments on time are crutial in a BK13 case. You don't want to take the chance of it getting dismissed and then all your creditors having at you! Did something happen to make you so behind? How did you get caught up?

I concur, I would not make a habit of getting behind. You usually only get 1 get of jail free card, which you just used. You get behind again, your case will probably end up dismissed whether you can cure the default or not.
