    Does it say anywhere on the court papers

    the reason for the bankruptcy? My attorney never asked me why I was filing, and I need to know if it shows anywhere?

    nope. the reason for the BK is that you are insolvent. doesn't matter why you are insolvent, just that you are.

    Plan Modified July 8, 2009 from $1100/month to $400/month due to change in income, finally discharged in July of 2013!

      I dont recall seeing it in print as to why we filed, but the attorney did ask us in open court during our 341 meeting. The trustee was there and he wanted us to state for the record why we filed.

        It's not in the paperwork...but the trustee sometimes asks at the 341 meeting. And even then, you only need give a vague answer. (illness, poor money management, loss of job, etc etc).

        Realize, the BK code does not require that you have a "good" reason to be filing BK. All the code requires is that you are filing BK in good faith (i.e. that you are not intentionally trying to defraud creditors).

          I never thought about them asking that question. We just told our attorney we were in over our heads. We couldn't keep going on like this. Basically poor money management and loss of wages over a period of time put us here.

          At least now I know to be prepared just in case they ask that question.
