As it seems to be with all all BK issues, it will more than likely depend on how the individual trustee does business.
In our case, our last payment was scheduled for January of this year. All creditors were listed as having being paid their predetermined % but the payroll deductions keep occurring. In late March I finally called the trustees office and inquired about the status of our case. I was told our case was in the process of being reviewed. For some reason, which I still don't understand even after they tried to explain it to me, I was told my payback percentage was being increased slightly but things were winding down.
Within a couple of days the additional money was disbursed to the creditors and a discharge recommendation was recorded on Pacer. After a couple more days, we received a copy of the discharge recommendation, a stop payment order, and the audit report in the mail. The report said that a refund check had been sent to us for the overage we had paid. A couple of weeks later - still no refund - so I called the trustee's office again, fearing something was wrong or it had been lost in the mail (our mail service has consistent problems getting mail delivered to the correct addresses).
This time I was told that even though I had the check # of the supposed refund check and the records showed it had been mailed on April, 1, they automatically hold on to it for 30 days before they actually mail it. As of now, we're still waiting for the refund check to arrive.
So, we're now 3 months past the scheduled end date and finally have the deductions stopped but still no refund. Doesn't make much sense to me but what are you gonna do? The government works in strange and illogical ways.
