My DH and I filed for Ch. 13 in Oct. of 04. We are in a 60% payback, and have been plugging along just fine. We are set to sell our home and pay off our 1st and 2nd mortgages and the remaining plan balance. Things have been going well.
Several months ago our 2nd mortgage was sold to yet another company. This is the second time since we filed that this has happened. We have received phone calls and statements, and I have informed them of our status and provided them with my attorney's information. The calls have continued, one last week at 9:30 at night. We called our attorney and gave them their info to try to stop this madness. Basically, the mortgage company has not followed the proper procedure to receive our funds (which are paid and sitting in our account waiting for them to follow the correct procedure so the trustee will release it), so they aren't getting paid right now. They have not so much as attempted to contact our attorney.
Last night our phone rang at 10:19 PM, and my DH was asleep. In his tired stupor, he grabbed the phone. It was the mortgage co., and the rep was quite agressive with DH. At that time we informed him that they would be charged with contempt of court for continuing to contact us. I again provided them with the atty info. This man continued to berate and harrass us, and made threats toward us. this of course led DH to say "This is bull*&$% sir."
I tried several mintues later to call the co. back, as I wished to speak with a mgr or supervisor. This same person that has been calling has dropped the ball, and I wanted it all straightened out. The same gentleman answered the phone, and knowing it was my number, proceeded to talk to me in a garbled slur. I hung up without speaking. Several minutes later, he called us back again, and disguised his voice. I asked for a mgr or supervisor, and was refused. He then left his guard down and gave up the whole voice disguise. He has refused to provde us with any information (address, etc.) and the customer service is horrendous.
Now he is threatening to file charges against us for "using profanity". Additionally he said we screamed at him (we did not) and called him 2-3 times. (We didn't, I called back once and simply wanted more information from someone else. When he answered the phone unprofessionally, I hung up without speaking and did not call back.) I know we shouldn't have answered either time, and I know we should not have spoken with him. I called my atty's office last night and left them a message and am just waiting for them to open. Has anyone else dealt with anything like this? I am very upset. I am ever closer to putting this behind me, and it feels like I just got thrust back to the beginning again (by having to deal with these calls).
