    Early Payoff

    I need some expert advice quick. I have an approved loan to refi my home and payoff my 13. It hasnt been a year since i filed and my lawyer's office is giving me a hard time. I called last week and they said i shouldnt be looking for a loan on my own they have people they go through. Is that right for them to be able to hold me in BK cause im not using their source? How else can i get out my lender wants to close next week. Not to mention my payment is going down $1100 and ill be totally paid off cause my BK was 100%

      Yeah i understand I don't need there lender however they arent helping me get the info i need to consumate this transaction, is there anything i can do on my own?

        What you need is a stipulation and order that you enter with the Trustee to incur new debt.

          Hello,
          The lawyer that is handling your chapter 13 for the court is probably upset - CAUSE HE'LL BE LOSING MONEY Especially if you pay it of very early!!
          Yeah, he's not going to be a lot of help I'm afraid. He'll say anything to keep you in it for at least 36 months or longer. He gets paid for shuffling papers for the court for ya........
          If refinancing and paying off is what you want to do - I don't see any reason why you shouldn't be able to since you said your payback is 100% anyway.
          Tell your lawyer what papers you need to file and then make sure he does. I believe he is responsible to the Trustee until your case is closed with the courts.
          Some of the others here are more informable in this area than I am.

          And since when does a lawyer think you have to use his lender?????
          DUH - still a free country, isn't it?

            Fire the Stinking Lawyer and pay the Trustee. That piece of crap isn't working honestly for you. I don't know the ins and outs of a 13 or what agreements are made but it is a hell of a thing for an Attorney to shaft a client when he can be free of encumberance.
