    hey my husband told me that it was 1,500.00 that he was behind on,
    and that it was 1981 when they split up till 2006 when we filed and partly why we filed!,
    If you think im lying than thats ur problem i told you my numbers were off and the state of ca screwed him, Why do you think that everything was lowered they knew they messed up, Also we had those kids for 5 school years and never stopped paying her the support, So dont act like we got away with something, We have it all here and we have talked with lawyers and :Enrique: (tell ya what give him a call im sure he can tell ya about that one case that the father was screwed it had them all baffeld) at the orange co support who also said is all messed up and they see where he paid and paid and paid never missing,
    So take off your happy glasses and see the real world where good people get screwed , And you think we were lucky that we got that down then your crazy!
    His ex had all the rights and the kids did not so who do you think suffered from us being lucky the mother has all the rights and we tried to get the kids, but i guess drugs and boyfriends and dumping them off for weeks at a time to anyone she could is lucky then i wanna be you in your perfect world! So yes That is what they did they ripped my husband off because not one person could figure it out ! And i already know the numbers dont match up they never did and still dont, so please just dont reply back to me because i came on here for a different reason not one where you breakdown our support payments and teach me a math lesson.....And accused us of being lucky, maybe you have problems with your own child support thats not my problem dont take it out on us. But hey thanks so much for taking off my glasses and seeing that there are still bitter people out there that will take something and run with it, And im sure u are sitting there waiting for a reply so you can type away and stir up stupid problems on someone elses problems, once again CHILD SUPPORT WAS PAID. and this time i gave you the the right amount 1,500 so type away and come up with how much we were screwed, not the ex!

      well the main issue is getting the orange county child support unit to withdraw their claim to be paid outside of the plan. Once that is done then you and your attorney and the trustee can determine where you go from there and if you are done with your case. GL

        I'm not accusing anyone of lying - but you clearly don't have all the facts because your numbers don't add up to your story, not even close.

        You have had lawyers involved and they certainly can ask the Orange county CA Child Support Services how a $1,500 debt could grow into a $45,000 debt in 21 years with a statuary interest rate of 10%. That is the first and most basic question. If your initial child support arrears of only $1,500 is true, then the State needs to reduce their claim by about $40,000. And if your husband really only owes $5,000 you would be foolish to settle for $25,000.

        So nothing adds up. Other than you not understanding the numbers and saying the state screwed you, I never figured out your original question. It's like this - if you have proof, legal proof of making all the payments until 2004, and only missing $1,500 back in 1982 - then any attorney or legal aid person could challenge the $45,000 bill from the state, and win. This didn't happen, so now you lose. If you can convince the state to include their claim in the Ch.13, you will be better off. But why pay a bill that is five times larger that it should be? Unless the State's numbers are correct...

          Here is the other issue that is going to come up. Here are the numbers:
          total amount of claims-----------$91,710.89
          total principal paid--------------$11,984.59
          total principal owed-------------$37,635.77

          With $92K claimed, it looks like the total to be paid in is about $48K (paid+owed). Even if the state withdraws a claim for $45K, the is still going to be $47K in unpaid claims that under the current plan would not get paid. Once the $45K comes out, the remaining cliams are still there and valid.

          This is all a little hard to follow, but even if the other party is willing to settle for less, I am not sure that is the right thing to do here. Settling for $25K and still being on the hook for $48K in payments will cost you a total of $73K to get the same thing you would have if you stayed in the current plan and paid out only $48K. Because you are not in a 100% plan, I think you are still going to be on the hook for your Ch13 payments.

          Instead of sending the money to the state, the trustees will simply send it to the other claims.
