    About the confirmation

    Ok,

    so my 341 is tomorrow, but in the paperwork I got with all the dates listed, it already has a date for my confirmation hearing. Is this set in stone? I sure hope so.

    The confirmation hearing will probably occur, but that does not mean that your plan will actually be confirmed. It all depends upon the trustee and any objections he/she may have filed.

      Are you worried that you can't be there on the date of the confirmationhearing? Because if that is your concern, you only need to be there for the 341, we did not have to go to the confirmation, just my lawyer did, then we got notice of the confirmation in the mail.

      Plan Modified July 8, 2009 from $1100/month to $400/month due to change in income, finally discharged in July of 2013!

        If the confirmation hearing is not to confirm your plan, then what's the reason behinde it? I don't quite get it.

          This has always been my question too. I asked my lawyer and he said the confirmation is more of a 'let us assume no one objects'. But creditors still have 2 more months, and Government entities 5 months, to object! Crazy!
          May 2008: Filed Chapter 13
          Jan 2010: Plan Amended and Confirmed! finally plan funds = total funds due!
          Jul 2013: 5 years done! Trustee set to discharge! Woo hoooo!

            confirmation means that the plan is funded and workable. Creditors can object to the amount they will get paid and then a compromise has to be worked out. Objections hold up confirmation because it could change the plan payment payout terms. Most of the time, confirmation takes place (with no objections) without you being there, only your attorney. But funding of the plan is the key. the 3 months and 6 months is the time frame for creditors to file their claims. You can object anytime. But once plan is confirmed creditors take what they are paid.
