    tax refunds/stimilus

    So in a 13 does the trustee get money you get from IRS such as refunds or stimilus? We just filed in June and did not owe any back taxes. It really doesn't matter I guess since if they do get it, then that makes me that much closer to being done with this nightmare. I was just wondering weather or not to expect my stimilus check. It is supposed to be mailed no later than July 11. I would like to put it away and save it for emergency.

    Depends where you live. Maybe when you filed your attorney listed it as an exempt asset since you just filed, I'd ask your attorney.

      Our Trustee told a person he interviewed ahead of us to notify him when this person's stimulus check arrived. I don't remember if that was a 13 or a 7. We are a 7. In our case, we owe so much to IRS that our stimulus was applied as a credit to our 2007 income tax, which was fine with us.

        it really depends on your trustee as far as refunds go and this extra check.

          My experience was that while I was still in a 'filed' status and not yet confirmed I received both my Fed refund and stimulus check. I was surprised as the IRS is the reason we filed BK13.

            We FINALLY got our stimulus payment on 4th of July--literally appeared in our bank account that day! We filed in early April and paid what we owed, apparently though it took them this long to process our return. We had back taxes in our Chp 13 also, but they were paid off as soon as the trustee started to disburse, since he sat on 6+ months of payments before the first disbursement.

            We do not have to turn any refunds or stimulus payments over to our trustee, we also didn't have to provide tax returns for this year, so we'll be putting the money to good use!

              That's GREAT, kmb!!! Just make sure you keep receipts and any all kinds of paperwork for the next 90 or so days--just in case! You never know.
