I filed ch13 and have my 341 scheduled for tuesday. I was wondering if anyone could tell me what a common objection would be? would it be to certain amounts in my budget? my payment is slated to be like 300 dollars after my lawyer played around with some numbers. Do they object to stuff like how much i set aside for gas or clothing? that sorta thing?

I wondered the same thing, we are getting ready to file and I made a 'budget' but some of the items are pretty high. My hubby commutes 120 miles a day and it included toll road fees, so I'm hoping the trustee will give us a chance to explain.

It sounds like you are surprised at how low the proposed payment amount was found to be. I almost fell out of my chair when my attorney quoted the original payment plan amount (I am still unconfirmed, but because of procedural objections by the trustee - he hasn't gotten around to examining the amount proposed). I fully expect to eventually end up paying much more.
The trustee will not make objections at the 341 meeting. You will answer questions and within a few days you will be notified of any objections. Good Luck!

Kornellred- well, my lawyer was pretty up front in saying that a lot of my expenses aren't really monthly. stuff just comes up like a car repair, or a certification due for work. cost of living in my area is expensive too. he said the only thing thats more than allowed exemption is my food budget. I'm athletic so i eat... a lot. The trustee is pretty laid back, but her assistant is ruthless from what i hear. So he said if we get lucky and its the trustee, then the plan will be confirmed no problem since he and his firm has a good relationship with her. if its her assistant, she'll give us issues just for the sake of it. can't help but laugh at the fact that it'll all be just luck. lol

Are they likely to object to child care costs? My son attends KinderCare for $163 a week. I know it's steep and I could find cheaper, but I don't want him to receive sub-standard care due to my irresponsibility.Disclaimer: Young, NOT Dumb.(._.) The plan: $480 monthly for 60 months at 100%. 07/12/08

They didn't object to $200/week care for our newborn (that wasn't born yet) or our $145/week B4/After care for our other two. I will say that as far as good care goes, I had my worst experience with Kindercare---but it all depends on the person in your kids room. I choose to go with an in home provider--and I don't pay $200 week any more...but they didn't object to the higher figure & I had the back up to prove it was legit!Chapter 13 Filed: 2/7/07 Confirmed: 5/1/07 Discharged: 3/2/2012 Closed: 6/2/2012
