    Question about 13 and payment

    I filed 13 about 8 months ago. I have all my credit cards, car payments and mortgage in arrears in 1 payment. I pay my mortgage seperately. I have been paying my 13 on time but fell behind on my mortgage due to a salary cut.
    I am now in default of my mortgage. We are most likely going to surrender the house to a short sale. I have new stainless steel appliances and a new pool pump/filter system. Would it be OK to take these items with me when I move? I am thinking I could sell them after we leave the house.

    Please call your lawyer on this and ask. But personally, I see nothing wrong with taking my appliances when I moved out. But I bet the lawyer can let you know if you will get in trouble.
    Does surrendering your home qualify you for conversion to a 7? That would be sweet.

      I am not sure if I can convert to a Ch7- I would know if I could actually get my lawyer on the phone.
      If I do in fact convert to a Ch7- would I be able to keep the cars?
      I am at peace with leaving the house- there are plenty of affordable rentals in the area- the cars on the other hand, are necessary

        Far as I know you can keep the cars, might have to sign a reaffirmation
