    How long can I wait?

    Husband and I are planning on filing. I stopped paying cc about 2 months ago and they are already calling 10 times a day- main ones Citicard and Chase.
    My question is how long can I not pay the cc before they try to file suit or wage garnishment? We would like to file in a couple of months but if we can wait to Feb or March thay would be even better.

    It really varies. I haven't heard of too many people getting suits or garnishments before 6 months though. Why don't you get all your ducks in a row to file in a couple months to be safe, then if you don't get any lawsuits you can hold out for as many months as you want, just be all ready to file at a moments notice so there's no stress or fear of the lawsuit since you would be able to file after getting notified and well before any garnishment could ever be put in place.     Plan Modified July 8, 2009 from $1100/month to $400/month due to change in income, finally discharged in July of 2013!

      Hi there,

      We retained an attorney in Mid May and she advised us to stop paying the cc immediately. We planned on filing at the end of July, we have all our paperwork ready and turned it, but we've decided to put off filing until Oct-Nov in order to save a little for emergencies (and to pay the remainder of the attorney fees). We were scared of garnishments, etc., but after ready this forum and realizing that it's not that big of a concern, we are going to "wait it out".
      Maybe you couldn retain an attorney (for a few hundred $$) and differ calls to him/her? The calls started immediately after the missed payments, but we were able to give our attorney's info and haven't heard a peep from anyone....
