We got our letter from the trustee yesterday, welcoming us to the wonderful world of our 13 plan. We will pay $3300 a month and his letter said the first payment is due October 25. I volunteered to have payments taken out of my check, but of course it won't kick in for a few weeks. Should I send in half of the amount now (will they "accept" 1/2 payment) then the 2nd half next payday, or send it all at once? I would like to make sure we don't overspend before the due date.

Seriously though, my payroll deduction didn't kick in the check I thought it would, so I called my lawyer. My payment was set for 1275 a month, and the court ordered deduction was 588.46 a paycheck. My lawyer told me to march down to the post office and get a money order and get it in the mail that same day. So while I would confirm with either the lawyer or the trustee, I think it is a good idea to go on and send in the partial payment, by money order or cashier check, and be sure to keep the carbon copy as proof. I still have mine, 4 years later.Chapter 13 filed -8/12/04

Trustee will accept partial payment as long as entire payment is paid before the due date. Before my wage deduction kicked in, I had to send two money orders a month, not a problem for the trustee. Actually walmart wouldn't make a money order for more than $999, so I had to send two anyway since I owe $1100/month.Filed CH 13 September 17, 2007
Plan Modified July 8, 2009 from $1100/month to $400/month due to change in income, finally discharged in July of 2013!

I was told to send in the full payment by money order the first time and then the rest have been taken through payroll deduction. You do have to make a FULL payment within 30 days of filing, so if you won't be able to make the remainder of the payment before 30 days, then I'd make the full payment.Disclaimer: Young, NOT Dumb.(._.)
