    His company said, you haven't paid your card, it is overdue. It's going to affect our (the company's credit). If you don't pay it in 2 weeks (by this Friday) then you will need to go see Human Resources.

    I do think pogirl is right. I do think this is a company card in my Dh's name.. It is so confusing. I STILL haven't heard from my attorney although I've attempted several times. I'm holding out until today and then we are just going to do a gift letter for the money from our family because I just don't see how this will work any other way. We CAN NOT risk him losing his job and as of know, no one knows about teh BK, which is a good thing.

      Based on your other thread, it sounds like you used the money from the expense reimbursement for something other than paying back the company's card, and then have personal expenses on top of that plus interest. Since a payment hasn't been made in over 30 days, this is getting serious with your employer.

      If I were in your hubby's shoes, I would make an appointment with HR immediately and inform them of the situation. Yes, this may mean disclosing the BK, but the ramifications of that will be much less than getting fired (which could happen). Be honest. Maybe they will do a repayment plan or a deduction from payroll to pay it back. The company will have to pay the debt in order to keep their credit in good standing and will then want to work out the debt between the company and your husband.

      They will most likely take the card away and your hubby will probably be written up or put on probation.

      Again, I would do this right away. They could outright fire your hubby in which case you would want to modify your BK plan.

      My experience with HR is that they will usually try to work with you, especially if you are a good employee. But, they like to find out what's going on from the employee and not from the supervisor or another outside source.

        I re-read your post and see that you have family that's willing to gift you some money. Just be sure they give you cash and then buy a money order to pay off the bill so you don't have to show it as income. Then, you can avoid the whole HR thing.

          Hi all-

          I wanted to give you an update of what our attorney said....make a bill of sale to my family members for items that we would have sold anyway and pay the cc in full. We will now have to wait until 90 days to file...which really is the worst because we were hoping to file next week. We already had everything set up to do so. So, we will have to play the waiting game and hope we don't get slapped with a lawsuit in the meantime.

          We will file on day 92, Monday Dec. 29. How fun will that be for the holidays? Oh well.

            What I don't understand is why the card wasn't paid off in full when the expenses were re-imbursed since it was a company card.
