    13 after 7

    I was discahrged on 4/20/08 chp 7. I have accured new debt od 65K. Since I can not file 7 I am left with a 13.

    What happens if there is no disposable income after all my exspenses? Is it a 13 with no payments?

    You need to wait 4 years from the date of your chapter 7 discharge before you can file a chapter 13 and have that 13 discharged. Section 1328(f)(1).

          Scooter, in the CH7 forum you said you have a old $34K debt. Now, you have another $65K debt or is this the same thing?

          HHM is correct, you need to wait April 2012.

                unfortunately if you file a chapter 13 you can't get a discharge. It would be a 100% payback 13.

                  the market just climbed 485 today. should limit some of the loss, maybe.
