Nervous and Need Help!

Okay, I thought I was over the rough part , but we had our 341 hearing on Wednesday and the trustee had no objections. today, I get a letter with objections listed.

1. Debtor lacks sufficient income to fund the plan.
2.The plan contains insufficient funds to make the guaranteed payment amount to general unsecured creditors.
3. The plan is ambiguous or incapable of ascertainment (11 U.S.C.) because it conflicts with statement of affairs #9.
4.The plan pays attorney fees in excess of that owed per the 2016b

Can someone please tell me what this means? I have been sick this entire process.

Not an expert here but it sounds like your attorney has maybe overstated what your disposable income is. Perhaps they have you paying much more than you can afford to last thru the plan. Also looks like your attorney has asked for more money be paid to him than owed. You should review your plan again with your attorney.

Sounds fishy to me...like the attorney is trying to pull a fast one? Hope not. Can you qualfy for a 7? Also sounds like your attorney understated your income since they are saying you dont make enough to pay the creditors? I hope your attorney will fix this for you...nothing you can do until Monday. I hate when this kind of stuff happens on Sat...

I contacted the attorney and he said No Worries, he will adjust the numbers and he must of made a boo-boo on his fee. I hope this lawyer knows what he is doing. We did not qualify for 7 and that is why we did 13. Our first 341 was reschedule because of the lawyer, he forgot to give them our paystubs!!!! He has not been reliable through this entire process. Too late to change now, I just hope he fixes this.
