    Lawsuit and Ch13

    Wife has been sued for +25k credit card default.

    She receives Soc Sec and I have full time job.

    Can she file Ch13 alone and stop lawsuit?

        If you can qualify, file Chapter 7. I was in the same situation last month, being sued for $15,000. I was forced into a Chapter 13. I filed before my court date (20 days from the time I recieved the summons) to avoid a default judgement.
