adjusting your payments

When I filed chapter13 in Dec. 04 our payments was based on our disposable income. Gas was a whole lot cheaper then.
Is it hard to get the trustee to readjust your payment. If gas stays at this price there will be long lines to file bankruptcy.

You would have to do an amendment to both your bankruptcy petition (schedule J), and to your Chapter 13 payment plan. And since you are asking to reduce the payment, you may have to file a Motion with the Court.

First, contact the trustee and see if they will stipulate to the proposed amendment, if yes,then its fairly simple, if no, then you have to make the amendments and file a Notice of Amendment giving the trustee time to object.
