    Questions about Chapter 13

    We are considering filing chapter 13 had have a few questions.

    The debt that we would include in the 13 is all my DH. I do not work and do not provide an income right now and do not have debt to include.

    The first question is do I have to file with him?

    If I did get a job with in the year would the trustee want some of the money I make even if I did not file?

    if any of the debt is joint, then it is beneficial to you to file with your husband. If not, when he is discharged, they will come after you. If not, then it becomes a personal decision whether or not to file as joint. Sometimes keeping one credit record clean can have its benefits.

    As to working, it would depend on how much you make etc. If you find a job making a decent wage, then yes the trustee will modify your bk and request that you pay back more to your creditors.

    If only 1 in the household is working, you would not qualify for a chapter 7?
