    Tax refund policy for ARIZONA Trustees.

    Anyone have information on this. I went to the trustee's website, and of course, they have just a stupid vague sentence that they want to review your tax returns and refunds, yet they dont specifically state anything.

    Anyone have any personal experience with this??

      I think it is handled on a case by case situation.

      We turned over, I believe it was, 3 years worth of taxes. We weren't asked to, we just did.

        3 years of worth of your tax refunds? Or tax returns?

        My attorney said, that the likelihood of them even looking at my tax returns is relatively low, and they would not want the refunds, but I'm not sure if he is right or not.

        He said, all they are concerned about is getting their check each month.

            There you go, you have your answer straight from your attorney. I told you what the Arizona Trustees office told me last week when I called them, "Ask your attorney." I have found that after you file Chapter 13, every thing seems to be a case by case, state by state issue. I think most attorneys attitudes are, let it lie and if it becomes an issue we will deal with it at that time. That's the attitude I am taking with my tax refund.

              The trustees office is ridiculous, you either want my refund or you dont, it doesnt make sense, their questionnaire say they "might" want it. Well that BS if you ask me, either take it or dont, cause if they want to just sit there and think about it, I am going to spend it, and if they want it, Ill say I bought diapers with it, too late.

                  I am in Arizona (Pima County) and all my trustee wants is to see copies of just two of my tax returns. I get to keep my refunds. It is stated in my confirmation plan that I am to send copies of my 2007 and 2008 returns only.

                      I don't think there is a cut and dry rule regarding tax returns. Each Chapter 13 is looked at individually. Your lawyer should be able to answer this question.

                        We had some trustee recommendations after our 341 and one of the items was that we had received "substantial" tax refunds the last 2 years (aroundc 6K) so we had to change our withholdings and pay our additional disposible income into the plan or turn over our refunds, so if you didn't get that, maybe you can keep your refund? (I have Maney)

                          I dont think my tax refunds would even come close to that much. So I suppose we shouldnt be worrying, and if we adjust our withholding correctly, it would just be more income for us to use on our allowable expenses, not DMI for creditors.

                            Just wanted you to know that Arizona sent returns to a bankruptcy department for review and then sent out the refunds by check about 2-3 months later. I had no issues with taxes but, when I called them they said everyone who filed bankruptcy was sent to their special department. I don't know if they will do it again this year or not.
