weired question with weired situation, my son's school ends at 12 and he not enrolled in after school. no friend around to take care of him. so thinking of taking him with us to the 341 mtg. would that be an issue for court/trustee? (the problem is he don't sit quite for more than 30 secs)

If he was mature enough to sit quietly and read a book there wouldn't be a problem. But if he can't sit still, you really do need to make arrangements. The court atmosphere and nervous tension surrounding a 341 is bad enough without worrying what your child might do.

most judges don't like a disruptive courtroom - including kids that may be loud.. I would pay for a sitter for the hour or two that you'll be gone. You don't want anyone being annoyed at your 341, you know?Filed Pro Se: 10/16/2009

I took my kids to one of my 341 (ages 6,4 and 2). My atty had no problem with it and stated that you'll be seen ahead of everyone else so that they can get the kids out of there. It was fine, and I think the trustee was nicer to us due to the kids.Filed Ch 7 - 7/29/08-UST prevented 7, converted to 13, paid 3 payments of $1500-2/19/09 converted to 7 UST dismissed w/o prejudice (atty error). Trying again in NJ either May or June with new income #s.

I took my 23 month old...actually though we werent before a judge we weren't even in a courtroom. It was very relaxed. We sat in the very back and when he started running around hubby trook him outside of the room and kept an eye on me and when it was our turn we went up. Its up to you--how old is your lil one? I have 4.11 yrs old boy. a trouble maker, brat and a talkative kid. and an expert at revealing home secrets...
I'd rather arrange someone to take care of him before trustee ask him where dad is hiding all the cash

Even if it isn't a "courtroom", it is still considered a "courtroom." You take an oath and it's serious. It's just no place for children. Also, I wouldnt want to take the chance of p&*## off the trustee. And it's not really fair to the trustee (or others that are there for their 341) because there can be sensitive information being discussed. Another reason - I was very nervous as most would be at their 341. I wouldn't want to worry if my children were going to act up. And last - I didn't want to explain to my children what they were attending and even if I didn't explain, they would certainly overhear others talking. I sure wouldn't want my business being broadcasted to the neighbors or their teachers. Kids will repeat things even if they don't understand.
If your child can't sit still for 30 seconds, is there a teenager that could sit with him for a few hours? I would hate for you to get there and have the trustee be one of those that throws you out because you brought children.Filed 11/01/08

Our trustee mad it clear. Absolutely no children allowed at the 341. Since we were leaving this morning at 7am. My daughters bus comes at 8:15am. My in-laws watched her last night and drove her to school. If we need them to pick her up they would have. I try to avoid taking my kids (who are well behaved) to ANY type of appointment. It can be distracting to other's, especially when you are in a room that is not ventilated, and noise travels easily. Do you know another Mother in the neighborhood, or school that you could ask to watch your son? Good luck......I do know what it's like to NOT have a babysitter at your disposal!

When you get right down to it, it's not really fair to the kids either. Expecting them to sit in some stuffy, boring court room and be quiet for God knows how long. Everyone will probably be much happier if other arrangements are possible
