    Adversary Proceeding

    Ok, I was told that lien stripping was not done in my district. I am thinking that it can be seeing as the suit to allow it in other places was in my state.
    What I am thinking my lawyer meant was that I would have to do it via adversary proceeding instead of motion. I am thinking there is a higher cost and more hassle to do that.

    Are debtor initiated adversary proceedings not allowed in certain districts?

    I do know they aren't covered under many lawyers initial fees and incur $125+ per hour charges. How many hours do they usually charge for? How do you pay that? Is it rolled into the Ch. 13 plan?

    I would really be so much better off in 5 years if I am able to strip my equity loan.

    Those are all excellent questions for your attorney. We can't really answer them here because it is up to your attorney how he wants to charge for the service.

      He can answer to the actual charges, but I was hoping to hear if anyone else went through the adversary proceeding, if that cost was paid during their plan or not.

      I am also puzzled why he says lien stripping isn't allowed. I am in the 11th Circuit where the Tanner case set the precedent. Can a district in the circuit not allow a lien strip process at all - by motion or adversary proceeding?

      If they don't allow the cost to be rolled into the plan and require advsary procedings for certain things, I can see why those certain things aren't done as no one would be able to pay their lawyer for such an action.
