    What do I need to do to get a Pay off letter.

    Umm, what are you talking about?

    Please fill in a little more information.

    For example, are you asking : since I have finished paying my plan payments, when do I get notified of such. If that is the case, your "pay off" letter is your discharge from your chapter 13.

      I'm trying to refinance my home and I was told that I need a payoff amount. I am finding it very diffcult to get a payoff letter from my lawyer. Can I submit a letter to the courts to get a payoff amount. Help.........

        So, you mean you want a pay off amount for your chatper 13 plan?

        You need to back up a few steps.

        1st. You will need to get permission from the Trustee to incur any new debt...like a refinance of a house.
        2nd. If you have been in your plan for less than 36 months, your pay off will be 100% of the debt owed to your unsecured creditors at the time you filed BK (regardless of what you plan intended to pay them).

        Just to clarify, what I mean...lets assume at the time you filed your chatper 13, you had $50,000 in unsecured debt, and based on your disposible income and other priority and secured claims in your chapter 13, your unseucred creditors were only going to receive 20%, or $10,000. If you want to pay off your plan in less than 36 months, you will have to pay all $50,000 to the unsecured creditors (minus any payments already received, of course).

        Incidently, why are you refinancing. If the only reason is to buy out of your chatper 13, I generally recommend against such a course of action as it makes little financial sense.
