    surrendering a trailer

    Hi everyone. We are going ikto a chapter 13 and have question. My wife spoke to the lender on a weekend warrior toyhauler and was told we could not surrender it, but had to quick sale it ourselves. Has anybody ever heard of this?

    If they won't let you surrender it, let them repo it.

      That's what I figured. Our attorney warned us that this lender (wachovia) would be the worst and was worried they might be trying something. Thanks for your avdice,

        My two cents

        We had a 2003 model Springdale 5th wheel and were current on the payments when we filed, probably the only thing (figured we might need it to live in ). Thought we were going to have to give it up as I assumed it was a luxury item. Not so, as it was listed as a secured debt and worked into the plan. Worked out that the claim was around used retail but less than owed. At least it will be paid for at the end of plan and about 10 years earlier than previously financed.

          I have a WW, but I own it out rite and was going to exempt it under the Ca wild card exemption. with WW going out of business it's value should be much less than you probably owe. possibly you could negotiate the balance down and pay for it through your plan. you might even get lucky, and they don't come for it. it's gonna cost them a bundle to repo and store something that size, thats why they want you to sell it and not them.
