I seem to recall a thread not too long ago that talked about this issue, i.e. horses in BK.
As to the horse, your attorney is correct, the BK trustee will almost certainly object to the expense. Short of you having specific case law in your district on the issue, about all you can do is argue fairness and humanity. You can't sell the horse (there really is no market), it has to be taken care of, and it is the debtor's responsibility to do so; thus, it would be inhuman to not allow the expense, etc etc.
But, as for your brother, the court does not care that he is not paying you rent, there is no requirement that he do so.
