    Received Letter to Appear In Court...Being Sued

    We received a letter yesterday that we have 21 days to respond to the holder of our 2nd mortgage's (we vacated and the home was already forclosed on) filing demanding a judgement against us.

    We have already chosen an attorney but not retained him or paid him anything yet. What do I do now? Can I give him a deposit and that will get me out of this? Do I need to fully pay him up front? Or do I actually have to file for a BK before the 21 days is up to stop this judgement? I know that isn't possible though.

    You will probably need to fully pay him to actually "file" your BK. And the BK is the only thing that will stop the lawsuit. You have some time, even if you don't respond, it will still take them a couple weeks to get the judgemnt.
