    Deferring Payments..never!! says attorney

    I have heard so much on these forums about deferring payments that it seemed to be almost commonplace....I asked my BK specialist about it and she seemed horrified, said he (trustee) would never do it and it would be cause for dismissal!!

    I'm 2 months behind on the mortgage and trying to get caught up but it will never happen, if both payments have to be made (they're each about $1600/mo). Just to satisfy my curiosity I emailed the trustee's office about their policy on deferred payments, then I'll take the next step.

    Also, when I couldn't make the full BK payment last fall I notified the trustee and the attorney's office...never heard from the trustee (oayment was made up) but XXXXX had a conniption and said we would be dismissed. That seems to be her answer to any problem I bring her, so I've pretty much stopped. She says there's no relief in sight until and unless my husband retires in January and the income is decreased significantly.
    So, I keep plodding on...

      My trustees office took our 3-month motion to suspend payments as pretty routine, just had to wait out the objection period by creditors and it was done. However, you need a REASON for the motion to suspend payments, some extenuating factor, not just that you have fallen behind. In our case, my hubby was put on disability for a back injury and his disability pay was much less than his normal pay. Is there some reason you have fallen behind that you can cite as a rationale for a motion to suspend payments? (other than you just had problems sticking to your budget).

      Plan Modified July 8, 2009 from $1100/month to $400/month due to change in income, finally discharged in July of 2013!
