I allowed my condo to go into foreclosure in Feb. 2009. Long story - large lawsuit - I sued the seller's realtor as they withheld information regarding the true condition of furnace and AC, massive special assessment, etc. Anyway, part of the reason I filed BK is I am terrified of a deficiency judgment . . . I'm sure it's irrational but I could not get past it. I had other debt to clear up as well so it just ended up being the best choice.
My question is - is a deficiency judgment wiped out in a ch. 13 or only in a Ch. 7? I am currently in a ch. 13 but I had a decline in income after I filed and I am looking to convert to a 7. I have not had one filed against me as of yet.
