    Newbie Question

    Hello,

    Came accross this forum a week ago and boy am i glad, I already had a consultation meeting with lawyer this weekend, however I forgot to ask them one question:

    I am married but it's only me who is filling since wife doesn't have a lot of debt on Credit Cards, now she is a cosign on personal loan and when i file for 13 will the bank come after her in regards to that loan?

    Another thing that i didn't like on meeting with lawyer, they told me my monthly payment is $705 without going through any expenses, will this number change since i have another meeting with them in about two weeks.
    I got all the paperwork to fill out and bring including the fee for lawyer, will this number change or that's it?

    The co-debtor stay (protection from creditors) for the non filing spouse will protect her, just as long as you are paying that claim (the personal loan she co-signed for) at 100% payback. If not, then you will want her to file with you. The attorney will most likely tell you this is the case, or they may not even know and tell you dont worry about it.

    The number may change, but it sounds like you are over median, and they already inputed your monthly income into the means test, which will give you a payment amount.

    Add up your expenses here



    then compare them to the amounts or categories listed here




    If you exceed the IRS expenses, let your attorney know, some categories can be exceeded, like medical expenses, or anything else that involves unique circumstances.
