    Confusing

    So I've started looking at PACER, probably a big mistake, but this is my question.

    The trustee has issued an order to comply with bankruptcy rule and notice of intent to dismiss.

    I looked up the items online, 1 is credit counseling cert and the second is a CH13 BK plan. Both of these items were included in the filing, I know I because I downloaded a copy from PACER.

    Is this a common kneejerk reaction to any CH13 filing or is something else missing?

    Is it common to have to have the 341 and confirmation hearing on the same date? Right now they're scheduled for the same date.

    I'm not a 13 specialist, but I believe, your 341 is your hearing. About the comments, sometimes they can be misleading. You do have a lawyer? He has access to PACER and you will always get in the mail what PACER is saying. 'Hub

      mine was same day. 341 at 10 am. 130 for confrmation. lawyer told me not to bother going. i didnt need to.

          There are two separate hearings at different times in the day, one is the 341, the other is the confirmation hearing.

          Anyway, I'm just going by the assumption that this is some sort of knee jerk, if/when I get something in the mail, I'll call my lawyer yelling and screaming

            you need to get your attorney to refile the cert of credit counseling again. with elect filings, those things don't always go through. THe trustee will indeed dismiss your case if the staff tells him your file is not complete. You need to get on this asap.

              I didn't not realize their were 2 meetings. I know what happens at the 341, but what happens at the confirmation?
              Filed August 09, all payments made as of July 12th, 2013.....Waiting on final audit and discharge!

                confirmation

                i don't know what happens in the room for confirmation but i tried to go to it and only lawyers were there and my lawyer said it is a simple procedure. judge calls your case. asked for anyone objecting then approves. then on to the next person. i also think my lien strip happened at that meeting too.

                  Depends on the district. Where I live (MO), confirmation hearings are not the same day. In fact, I noticed my confirmation on Pacer prior to any notification from my attorney that there was even a confirmaton scheduled.

                    I was told in my district that the confirmation hearing is set for 30-40 days after the 341 but that the judge will actually sign the confirmation a day or two after the trustee recommends confirmation and cancel the hearing.

                    The hearing only goes forward if there is an unresolved objection that needs the judges ruling.
