    First payment due 11/27

    My wife and I filed C13 on Oct 13th. During many caculations the lawyer came up with $ 1250 a month starting 11/27 for 46 months.My delema ,at the present time we have a minus $1200 dollars in our 2 checking accounts. (Bad subtracting etc.). We are going to have to not pay some bills so the checking accounts can come back to normal. I sent an e-mail to my lawyer to see if he can change it to the 3rd of every month so I will be able electronicly pay the trustee every month. My question, what happens if the first payment is late.
    During one of the lawyer meetings he suggested I quite my job then we would be able to file C7. At present my hours are slowly decreasing due to the cotton fields slowly being destroyed. (I work for the Texas Boll Weevil Eradifiction foundation). Soon I will be laid off or hours would be about 30 hrs week. I would be rehired in March 2006. If I am laidoff do you think we would be able to file for C7. We have other Income, 2 pensions and 2 social security. The wage I get from Boll Weevil takes me over the limit (Disposabe income). We have not had a meeting with the trustee yet.

    You need to contact your lawyer and make sure he contacts the Trustee about this and getting the date changed to the 3rd. Surely the trustee will do this if you make arrangements.
    If you don't make arrangements, you will be in "default" and they can dismiss your case on you.

      Contact your and get it in writing also. One day late with the Trustee is a big deal. I would even contact the Trustee if the Attorney drops the ball. Don't volunteer excess info (bad accounting to the Trustee). try to autopay when possible, I use it and i have found that it reduces alot of stress. I have never used much cash since the 80's.

        I finally got a call from my lawyer to day. This is what he said. Pay any amount on 11/27 (About $300) then the rest on the 3rd of the month.This shows good faith with the trustee. When we go to the 341 meeting we can tell the trustee about our 3rd of the month plan and should be ok. He got this info from the trustee. It seems these trustees are so busy these days that it takes a long time for a call back.
