    chap 13 in Florida tax refund?

    Im unclear what happens with my 2005 tax refund becuase i am a 100% disabled total and perminate veteran my wife and I get about 5k tax refund every year. (also we have 3 kids and a part of it is the new child tax credit)

    traditionaly my wife doenst claim any exemptions so her withholdings are rathter high all year but we get all of it back. This refund is then used to pay several bills that are due anualy (cheaper to pay once a year than monthy) (10% discount)

    the remainder is used for one home improvement or repair wither its a car repair home repair etc etc

    this year does all the moeny go to the trustee? part of it? do we get it and hten have to report it? how?

    does this go to our 20% settlement? lets say we owe 20k in a 5 year payment plan do we then only owe 15k? and the paln is accleerated? or is the moeny simply bonus to the creditors?

    if we get no credit is there a way to claim part of it for our yearly bills ? or have hte refund defered for next year prepay taxes etc?

    This is vague-but it will depend on your trustee & your district.

      3400 withheld 1600 child tax credit for a total of 5k est tax return.

      we settled for 20% with a 5 year plan we have about 25,000 to pay during this plan.

      so does mr smith get all the refund?

      does it get applied to the plan and accelerate the plan?

      when I E-file this year like every year what happens?

        No one here will be able to tell you that. This is something that doesn't have a set policy. The trustee will make a determination based on your case. This is something your attorney can probably help with. Most likely, your attorney has dealt w/ the trustee on other cases and will have an idea of how the trustee does things.

          I'll have to ask him then.. he isnt kinda hard to get ahold of. I understand he isnt there to hold my hand but there are times i wonder why its neer impossible to talk to him

            The information I recieved from my Trustee is that if you are up to date on your C13 payments you will recieve your $. Try to file early as possible. I use mine to pay property taxes and the first big payment for our Home insurance which went sky high.

                Im current. I had paid for 6 months then the plan was appoved and made offical it came in at a higher amount than orginaly proposed so now it shows a 4 month credit on a 60 month plan instead of a 6 month credit on a 3 year plan.

                Are you in florida? Im having a feeling that each state is wildy different. each year about 2500 goes to paying once a year bills and the other half to repairs or improvements
