    income tax refund

    I have searched the IRS site and looked over the income tax 1040 form and I cannot see any where about bankruptcy. My question, how does the trustee get the check? My trustee says he will send the check to the taxpayer if that person is up to date on the payments.

    Tax Refunds

    Our trustee sent us a letter that directed us to send him the first two pages of our filing for the tax year. Then when our refund came to us...we were to send that money to him and we had until a certain date to do that. It seems that all trustee's have a little different way of doing things?

      Answer:
      Treasury's ability to withhold a taxpayer's income tax refund is determined by the chapter under which the bankruptcy was filed:
      Chapter 13--Income tax refunds are returned to taxpayers.
      Chapter 7--The refund is held until a discharge is issued.
