    Mortgage Payment $300 Higher? Attny fees?

    I just submitted my January mortgage payment, and noticed that the total due was $300 more. I called GMAC to ask what this was for, and they said "fees, we will transfer you the lawyer". So, they transfer me and I get a VM.

    Why am I having to pay GMAC lawyer's fees? I am doing a ride-through.

    I filed on 11/24, and my December payment was for the correct amount, but now there's this additional $300 showing.

    Anyone have any idea? I also have a call in with my lawyer.

    Is it possibly escrow related (increased taxes or insurance, or maybe there was a shortage in the escrow account)?

      Nope, my payment re-adjusted in December to cover the escrow shortage.

        Just curious, do they know you're in bankruptcy?

        I have wells fargo and they were pretty sharp about "bills" turning into "information statements" so as to not violate the automatic stay.
        Same thing for Toyota Motor credit corp.

        CLC consumer services, not so smart.

        Sounds like you'll have to keep hounding them for an answer. :-(

          Yes, they are aware. My December statement basically said "This is a Statement only" all over it, and showing the amount due on 1/1 for $1410. Had I not paid online I would have no idea about the additional $300, as I never received any notice of this. I only paid the $1410, but there are fields on the payment confirmation which says Amount Due : $1410, and then a Total Amount Due of $1710, with $0 for Outstanding Late Charge. There is no indication anywhere of where this $300 came from. I'm really worried now as I have my 341 on Monday and I hope this doesn't effect me being "current", as I paid what I am required to pay towards the actual mortgage.

            My second mortgage is with GMAC. After I filed, my statements became "informational" but also included a $300 "other fee". When I called about this, they informed that it was their attorney fees because I filed.
            When I called my attorney, she said that they can pass their legal expenses along to me. So I have been paying an extra $10 each month towards these other fees.
            Wells Fargo is my first mortgage and they have not charged me any fees. Both mortgage companies filed objections to my filing, so they both had legal expenses, but apparently only GMAC felt the need to charge me for them. Both objections were minor wording issues that my attorney easily worked out.

              Since you are only paying $10, they are not considering you past-due on your mortgage, correct? That's the only thing I'm worried about. Along with racking up late fees. I won't have the $300 until after my 341 on Monday, and I wanted to be absolutely sure I was current @ the 341.

                I actually went a year just ignoring the $300 other fee, it just sat there from month to month. I just made the regular payment, on time, every month. They never added any other fees.
                I just decided a couple of months ago that if I started adding an extra $10 per month to apply to the other fee it would be pretty painless to get it all paid before the end of my plan.
                I think it sucks that I have to pay their attorney fees, but big picture it's a minor thing and I don't want to get all worked up about it.
