    Chapter 13 & redemeption

    This is a dumb question but I have to ask:

    a friend of mine filed for chap 13 to keep his house. He is driving a vehicle that belongs to someone else and they want it back, chould he go through 722 redemption to purchase a vehicle?

    722 Redemption only applies to ch. 7.

    He could possibly petition the court for permission to take on new debt to buy a used car.

      Hasn't had the 341 meeting yet, would he still need to petition the court for permission?

        I'm pretty sure. At this point, trying to incur new debt without the trustee's permission could get his case dismissed. Not something to be taken lightly!

          if you are in a chap 13 the trustee must approve the new debt first from everything ive ever read.
