momofthree, will there be a problem if I buy a car that has payments of around $600/month before I file for BK 13? I understand that the ch. 13 allows $489 or so per car but what happens if your payments are over the allowed amount?
I got a ton of crap from our trustee for having 1 car payment of $599 (it was $550 but to pay it off in 5 years (6 year loan) it became $599) and one of $600. I had to detail out all the options my car had, how much I paid, etc. He acted as if he would object to both cars, but he didn't. To be fair, the $600 one will be gone in Dec (it's a lease)and my allowance to replace it is $475 or so at that time.
Do not go over $500, it's just not worth the hastle. And avoid luxury brands like BMW, Mercedes, etc. They raise an immediate red flag no matter what you paid for it.
