    chapter 13 and tax returns

    When we filed chapter 13 in Tennessee Dec. 2004, our attorney told us not to file electronically on our Income Taxes till our plan was confirmed. We just mailed it in and recieved our refund. He told us we could keep the money.
    It's tax time again so I wanted to know if we need to mail it again like last time or can we file electonically. I called my lawyer and left a message but I haven't heard a response from him yet.

    Peevee, same thing happened to me. In 2004, I had to file my mail because of the bankruptcy. In 2005, I filed electronically. Unless you were ordered by the court to SPECIFICALLY file by paper and send them copies, I would use Turbo Tax. You can print out paper copies anyway through the software.

      I agree with Jman, we have continued to do turbo tax with no issues at all, just remember to give the trustee a copy of your return each year.
      Of course, like he said, unless you are specifically instructed to do differently
      by your attorney or the trustee.

        I guess I got lucky on this. I don't even need to send the Trustee copies of my tax returns. They want nothing to do with them. I even asked my attorney and he said unless they specifically ordered it, which they did not, I was free to do the taxes on my own, as usual.

          Hey Jman30..Is Frank Pees your trustee?? That is ours and we are in central Ohio. He seems pretty fair so far. Our attorney told us he usually wants nothing to do with your tax refunds. He wants you to use it to get back on your feet. Imagine that...a nice Trustee!

            im lost. you should be able to file however you want. makes no difference. print a coopy and give it to him.

            maybe the trustee didnt want you to have it electronically deposited into the bank. makes it more difficult to get at and show payments and why and wehre the money came from maybe.

            hows this sound? what did i miss?

              KYJOE - No, we filed in Dayton, OH and our Trustee is Kellner. Our attorney had the option of filing in either Cincinnati or Dayton and chose Dayton because he said the Trustee in Dayton is much fairer and easy to work with.

              BKFILER - When I first filed in 2004, we received a packet from the court and it said ALL tax returns must be filed non-electronically until the case was confirmed. I don't know the exact reason why. The Trustee has the option of taking your tax return checks while you are in the Chapter 13. However, when my case was confirmed, there was no mention of taxes or tax returns and my attorney said I was free to file as I normally would.

                well like i said, did they mean electronic for payments or filing?

                i still dont see a reason for filing either way. payments i do see a reason for getting a check in hand. but for filing it couldnt make any difference to them.

                if you find out let us know.
