    a little nervous today

    We are set to file tomorrow. The creditors are starting to call and get suspicious. I'm only concerned about a couple of them, one for a vehicle, and another for a secured loan where the assets don't even come close to the amount we owe. ($600 collateral on an $8000 loan) Is it true that I can "relax" a little after 90 days or so? What do I need to do now?

    I know I'm like everyone else. Good days and not-so-good days. This forum is truly a sanctuary for me.

    Did you file chap 7 or 13? If it's chapter 7 and your case is filed tomorrow, you should be discharged within 60 days or will know within that time period if there are objections. We had a couple of creditors like MBNA that were worrisome. No one showed at the 341 meeting. Now we are waiting to turn over our tax refund and hopefully close things out forever! The waiting was the worst for me. I hated the period before the 341. After the 341 everyday got a little better. I had to take sleep medication for awhile!

      it's a 13

      We're doing Chapter 13 after asking the attorney specifically if we could file a "hardship" Chapter 7 for medical reasons. We make "too much money" and don't have "enough" medical expenses.

      I'm already taking sleep meds and meds for anxiety. My doctor wants to wean me off the anxiety meds! Think I'll tell him no way until after the 341 meeting!

        Jane, we noticed an immediate relief literally the day we met with our attorney. We filed that same day, and she told us to tell everyone (creditors) we filed and to call her with questions. It was WONDERFUL when those calls stopped, and they did stop immediately. Don't worry, once the filing happens,even garnishments and judgements come to a screaching halt and you don't have long to wait for that. Kelly : )

        also wanted to add, we have a chapter 13 as well, so believe me I know all about it!

          341 meeting

          Good luck tomorrow and with your chapter 13, once you file and tell the creditor to stop calling, that should end all contact with them for good. Most creditors will not or can not object to a chapter 13 plan and probably will not show up for your 341 meeting. I had 28 creditors and I was prepared to battle maybe 5 or 6 of them; no body show up for my 341 meeting, it was short and simple, in and out in about 5 minutes. Remember not to volunteer any additional information not asked, keep your answers short and simple, just state the facts and than be quiet, (keep your month shut!) the less you talk the better off the meeting will go.             thanks for the info

            I've got my short responses to creditors all set! When I emotionally detach, I fare much better.

            Think I'll celebrate tomorrow evening! Any suggestions?

              Get suspicious of what? Next time you get a call from them, tell them to take their monthly statements, late fees, 30% interest rate and harrassing phone calls and jam them up their ass.
              Welcome to relief with ch 13!
              Last Spring, We had 21 creditors and 3 have local offices right in Manhattan, less than a mile from the BK district court, and not a one showed at our 341. It literally took me longer to find a place to park than it took for us to meet with our trustee.
              I sleep better now too And, between the shrink I see, and the employee assistance people the city sends me to once a month, I may get off my meds soon too

                Keep in mind that you don't have to say much, they will drop the call like a hot potato when the hear bankruptcy....all I said was, "we have filed chapter 13, and this debt was included." The caller would then ask for my attorneys name and number, and hang up. That was it, simple as that. We also didnt have so much as a peep from any of our creditors as far as objections and none showed up at the 341 meeting either. The trustee was fine with everything, too.
                Here was our time frame:
                July 30, 2004 FILED CHAP 13
                Sept 10, 2004 341 meeting
                Nov 18 2004 plan was confirmed. The trustee payments started in August, even before it was confirmed, which is standard I guess.

                And speaking from experience, you will be sleeping like a baby,much less anxious as soon as you file! Its a big relief to be taking charge of your problems.

                  thought about changing my number!

                  I may end up changing my phone number, although I've already gotten the hang of giving my short, "sweet" relpy to the creditors!!! LOL

                    So, Jane, do you feel better now after filing???? Hope so, I know we did. And just as an FYI, we never had to change our phone number. The calls stopped
                    almost immediately after filing. And remember, while being in a chapter 13 can be a drag sometimes, its not the end of the world.
                    If something drastic comes up, check with your attorney about an amended plan. We were even able to get my son braces in the middle of ours, they actually made our payments $302 a month for 2 months, instead of $1302, so we could accumulate the $2000 down payment the orthodontist wanted, and they didnt quibble about us taking on the extra $75 monthly payment either. It was no problem at all, just required a little paperwork.
                    So, keep that in mind if you or your family have something come up. Now the next step is the meeting of creditors, it will be short and sweet and is nothing to worry about(though you probably will anyway, I know I did : ) We did not have a single creditor show up at all. So let us know how everything else goes, ok? Have a nice free-from-pesky-creditor-phone-calls weekend! : )

                      We got Vonage (which we love) right as we were filing and weren't able to keep our same phone number - so our phone RARELY rings - sometimes days without a call. Ahhhh - peace!

                      Hang in there - we filed and the trustee objected - so we have another meeting this week with our attorney to get it cleaned up. I just keep making my payments and staying in my budget. I feel 100 times better knowing that we are in 13...
