We are in Chapter 13 in NC. Was just wondering the "rules" for reporting salary increases and/or job changes. Are you allowed to "keep" a certain percentage for cost of living or do all salary increases during the duration of your plan go to your creditors? Anyone have any experience with this? Thanks!

I've heard you have to report any increase greater than 10%, but that is hear say, I would contact your lawyer. That would be great for me, I can't remember any raise greater than 3% in the past 5 years.Chapter 13 Filed 4/03/06  341 Meeting Complete 5/11/06 :yes2:

Usually all changes in income are reported to the attorney handling your repayment plan.... this includes any lost wages, job layoff, etc....
Your plan will be adjusted accordingly... either way.Minny

My suggestions are from "personal experience" and research only. Do not consider this as legal advice. Each bankruptcy case is different.

Thanks for your replies. My husband's department is being merged with another resulting in a salary increase to bring him in line with the other employees in that department. 7 1/2% plus 2 % normal cost of living increase that they receive each year. We've contacted our attorney, but are still waiting to hear back.

You're probably OK. Close, but, hopefully OK.
All the attny paperwork we've seen asks about anticipated income increases or decreases in excess of 10%.Filed Ch 7 - 09/06

I am not an attorney. My comments are based on personal experience and research. Always consult an attorney in your area to address concerns related to your particular situation.
