    Amendment question

    Has anyone who is in a Chapter 13 ever gotten pregnant durining the pay back period? I am just wondering how hard it is to get an amendment to the plan? Thanks...

        Talk to your lawyer. The proper term is plan modificationand it's perfectly reasonable since, your financial picture has changed.

          Yes, a modification isn't a big deal to get, especially in a case like yours where you will have an extra dependant and extra daycare. Totally changes
          your disposable income. Your attorney can request it.

            Just playing the devil's advocate here, but will the plan length play a factor in a plan modification? For example, I'm paying 100% over 36 months. If my wife gets pregnant and I try to initiate a plan modification, how likely would it be for the trustee to just tack on a few more months of payment to compensate for the lower monthly payment?

              One big key in modifying a plan is, unsecured creditors can't get less in a 13 than they would get in a 7.
              So, to answer Quickteg's question we'd need to know why you are in a 13 with a 100% payback? High disposable income or, too much equity in a home?
