    341 meeting scheduled

    We got our letter from the Trustee yesterday. Our 341 meeting is scheduled for 4/4/06. At least I we know when it is.

    Just got a call from my husband. Someone rear-ended him on his way to work. Thank goodness no one was hurt. My husband said that the highway patrolman acted like he was going to run off because my husband told him they had already exchanged insurance info, etc. What a jerk-- and he listed my husband as vehicle 1. Based on my experience if you are listed as vehicle 1, your insurance is responsible. Anyone know about this or am I just crazy?

    Jane, in a rear-end accident, its always the presumed fault of the driver that hit the car in front. Your husband being deemed car 1 was probably for no other reason than to distinguish what happened for the police report.
    For example, "car 1 was stopped at a stopped sign, when car 2 lost control of its brakes and hit car 1 from behind." Sometimes there are even more vehicles involved.
    In my experience this has absolutely nothing whatsoever with insurance liability. Your husband does need to file a claim right away with the other ins
    company.
    If he needs to go to the doctor, he can do that as well and his own company will pick up the tab for that but then recover it from the responsible party's insurance.
    That is standard procedure so you can seek medical treatment if you need it, right away, and not wait around for it to be sorted out as to whose fault it is.
    Unless your husband was committing some glaring traffic infraction, there is literally no way this rearend accident is going to be his fault.

    Sorry it happened!! Glad hes okay. And by the way, the 341 meeting is a cinch!

      My husband did call our insurance agent who told him to get in touch with the other man's insurance company. Our agent also told my husband that the other man's insurance should pay.

      Guess I'm just a little more on edge than I normally am with all this c**p going on!

      Thanks for the reassurance about the 341 meeting. I keep hearing that it is no big deal. We've already sent 1/2 of a payment and plan to pay the other half before we go.
