    creditor still calling!

    Hello all!
    I have a creditor that is included in my CH13 filing (Home Depot - but, technically is Citibank), but they continue to call me for payments. They've been contacted as part of the filing, AND I've sent them an email with the case number, my lawyer's number...yet I still got 2 calls yesterday. But I filed last December -- shouldn't they have gotten it together by now?!? What else can I do to get this to stop? Don't they legally have to stop?

    YIKES!!! They are in violation of the law, and could be sued! Have you notified your attorney that they are still calling you? Were they listed on your BK??

    I have good story----our calls all stopped immediately after filing, but a couple months ago I got a random call from a CA. There is someone in my area with my same name, so I didnt worry a whole lot, just called them back assuming they had her bill and were calling me by mistake. Well, turns out it was my bill, but was from 1 yearprior to my filing chapter 13, and had been included in the bk.
    I nicely explained, '"there must be a mistake, we filed chapter 13 in 2004 and
    this was included."
    She WENT OFF on me!!! Said, "excuse me, I checked all this out thoroughly
    before calling you, I know how to do my job, I know you filed BK but this was for after the filing date, and you have to pay it NOW!!" She then went on again to say how much research she does before she calls, so as to avoid violating the law, etc etc. I then said, " am not paying that, and you need
    to call the drs office and ask them what the dates are, because this was from 2003, and included in the bk, which we are paying at 100%."

    She got really mad but agreed to do it, so she could "prove" her point to me,
    then called me back and said in a very "small" voice that she found out that
    these were from 2003, and included in the bk and she wouldnt be calling me again...!!!! HAHAHAHAHAH!! that made my day.

      I had one of my creditors call me about 3 weeks asking for their money NOW or they would take any means necessary to collect it. I couldn't get in contact with the guy to tell him 'Hello, you're wrong. This debt is included in my plan", so instead told my attorney and he pretty much handled it. I would talk to your attorney and have him handle it.
