My confirmation paper states that I turn over my tax refunds to the trustee. What is the procedure for doing this? Do I just sign the checks and mail it? The paper says to "execute an assignment of tax refunds". Not quite sure what is meant here. $1000 of my refund was for the child tax credit. I assume he gets that also? Not for sure on that either. Anybody else go had to do this? Let me know. My plan is set for 10%. My refund is roughly $2700.

Did you use and attorney, let him handle it....
If not call the Trustee's office and see if they want you to send the check to them or if they tell you how much they want of the check....
Keep us posted.Minny

My suggestions are from "personal experience" and research only. Do not consider this as legal advice. Each bankruptcy case is different.

This is where things become so murky. We filed Chap 7 in September. Trustee says at 341 to send a copy of tax returns to attorney upon filing. Nothing else. Mailed copies to attorney over a month ago. I have heard no official word from Trustee or attorney if the return is being taken or amount.
Doesn't some paper document need to be sent to the debtor clearly clarifying this event, and how much is to be taken? Anyone with experience I love to hear from ya!! Our attorney says to endorse the checks and send them to him, (nothing from trustee). I'm hesitant to put $3500.00 in the mail with no word of confirmation whatsoever!!!!

We were told that refund checks need to be endorsed to the trustee. Never
had to do it, because we didnt get one till after it was paid off, but thats what we were told. Although it must depend on the trustee, because I have seen others on hear stating that they were to send the money to the trustee after it was cashed.
