    Mortgage payment and credit report

    I have one months mortgage payment included in my plan. I fell behind on one payment near my 341 meeting. They filed a relief from stay, but my attorney worked it out that I could make up the extra payment over a 6 month period. They have never billed me the difference, but I have been paying it every month. My April payment will be the sixth month of making extra payments. On my credit report my mortgage company shows that my account is staying one month behind. Can I get this changed, or dispute this? I don't really see it being a month behind since they worked out a payment schedule. Maybe when I make the April payment, they can adjust it.

    It should show one behind, until you have made the last of the extra payments. I know with our mortgage company, they hold anything less than a full payment in a suspense account, and do not apply it until it equals a full payment.
    So, after you have made the last of the partial payment amount, I bet it will
    report current.

      Your credit report will not change until you are making current payments and they report as such to the bureaus...

        My atorney said if you're late even one month...

        that you have to include your whole mortgage in the BK! I was thinking I might need to skip a mortgage payment in order to pay attorney fees and other stuff I need in order to pay for my BK. He said if I'm one month behind my mortgage then I'll have to put the whole mortgage in.

        BK Paul, did you include your home mortgage in your BK, and if so, did you file after the law changes?

          I think all it is is that you have to claim them as a creditor for the arrearages--I don't believe thats what causes you to have to pay the mortgage through
          the bk trustee. But if you are behind, then the amount you are behind goes into the chapter 13 plan.
          I know in our case, we were several months behind, so we included the arrearages and stopped the chance of foreclosure, but continued from that
          point to make regular payments on our own, outside the chapter 13 payment.
          We filed before the law changed.
