    Can you keep cash when filing a 13?

    I tried searching for this but couldn't find an answer.

    If you have say 10k in cash and you file a 13, does it get taken right away or do you get to keep? If this was a 7 filing the cash could be exempted due to a lack of other assets.

    if you can keep, how does that affect payments? At all? cash/60?

    You would exempt it just as you would in a ch.7 filing. It won't affect your payback if you have the exemption available.

    If you lived in a state where you couldn't exempt it, then it would be considered a non-exempt asset and you would have to pay at least the value of the non-exempt asset (in this case $10k) towards your unsecured creditors over the life of your 13 plan.
    Filed Chapter 13 on 2-28-10. 341 completed 4/14/10. Confirmed 5/14/10. Lien strip granted 2/2/11
    0% payback to unsecured creditors, 56 payments down, 4 to go....
