    after the payments

    Does anyone know if you are having you payments automatically taken out of your paycheck if they stop right after your mandatory payments are made. we are in our 3rd year (36 months) and i have the payments coming out of my paycheck when the 36th payment is made do they stop then(i hope???)

    No, the wage order must be submitted through the attorney to the courts, and when the judge orders it to stop, they notify the employer. The employer is basically obligated by law to keep deducting till they are told differently by the courts.
    And the trustee does not and can not request it to be stopped either, so if I were you I would submit the request to the attorney about 3 weeks before the last payment is deducted, because otherwise there could be a lag time inbetween that could cause more deductions to come out after the last payment is made.
    That way they can get it underway and the timing should work out ok. Now if they do end up taking more than you owe, they will refund it, BUT---I know from experience, they take their sweet time doing so!
    Not the end of the world to wait, but after paying for 36 months, who wants to wait on the trustee for their money?
    I just finished a chapter 13, so believe me, I know what I am talking about!
