Have been in a CH13 for over 2 years. Our expenses are changing soon, enough that we'll not be able to fund our 13 any longer. I am happy to convert to a 7, I regret not doing the 7 right out of the box, but better late than never right?
Anyway, part of our 13 was to strip our 2nd mortgage. Naturally the 2nd will go back in to force with the conversion. Yes the 2nd will be considered delinquent, but truthfully, first is underwater enough that they won't be able to foreclose in the foreseeable future. Is this going to cause any problems with a conversion? I mean can the fact that the 2nd is delinquent while the first is current hurt or interfere with the conversion process?
Our mid term goal (next year or two) is to relocate to another state. The 7 discharge will allow us to walk away from our home when the time comes, so we aren't overly concerned about the 2nd "looming over us".
