Went to my first meeting today and the payment my attorney gave me was outrageous!!!! It looks like all he did was divide my total debt by 60. It doesn't seem like he figured in my expenses or anything. WHY??!??! Isn't that why I have figured my expenses? There is no way I can pay this payment every month and be able to survive! What do I do now?????

I haven't hired him yet, just went to our free consultation. He said we wouldn't qualify for ch 7. As far as the house, we owe about 130,000. Our last appraisal had it appraised for 135,000. Our last assessment notice was at 148,000. What would they use to determine the equity? As far as the vehicles, one is paid for (10 yrs old, over 100000 miles), the other we owe about 9000 and is probably worth about 10000.

Appraisal - (owe on your house) - (liens/HELOC) - (cost to sell house) = equity
If you're equity is less than the homestead exemption in your state, then you may qualify for Ch 7.

Attnys think that you come to see them, you'll go along with whatever they say to do and you'll hire the first one you visit with. I think more than a few people here have had a Consult like the one you experienced. Myself included.

I agree with sinking- get more opinions. My first consultation gave me a quote of almost $900.00 a month, which was TOTALLY outrageous and there would have been no way in hell I could of paid that everymonth.
Our second consultation gave us a quote of $300.00 a month, and he stood by it and it was confirmed.
Do your homework and get a great attorney....some are just paper pushers, but there are some out there that actually want to help you. Good luck!
