i had a brief consultation with bk attorney other day about filing chapter 13 and he said i had to pay him $3k in attorney fees first before he could start filing. I thought it was just the filing fee of $284 or` so and attorney fees would be paid through the payment plan.. Is this true with all chpter 13 attorneys.Becuase i was told by some that chapter 13 attorney fees are paid throught the plan that is approved by court. plz help...thanks

I don't know if the bk reform laws changed this or not. We paid $300 up front, and the rest came out of our payment plan. It depends alot on the attorney and if he is willing to accept payments through the plan. You can and should ask the attorney how much they are willing to "finance" in the Chapter 13 plan. Most in this area allow you to finance 1/2 of it, though I have seen some attorneys take very little and finance almost all of it in the plan.

Most here, where we live, were charging about the same up front as they would get for a Ch 7 filing. The rest was put in the plan payments.
If the attny charged $2800 for a Ch 13, you'd have to pay about $1K, give or take, plus your filing fee. The remainder of the $1800 or so was put in your payment plan.
It varies from attny to attny. And generally speaking area to area. The attnys in one area all tend to do about the same thing.Filed Ch 7 - 09/06

I noticed the case my attorney filed the same day as mine. It showed her taking like 295 bucks and financing the rest in the plan. I was kinda pissed as she wanted 1295 from me. Of course, the lady she took 295 from was at the same 341 meeting as me. I understood at that point why my attorney more or less did the work pro=bono. (I know she will get paid, but it will take the entire 3 years probably to pay her off).
